Rural Hairdresser- Planning Enforcement Success.

MKA Planning have been successful in obtaining planning permission for the retention of a hairdressing unit in a domestic garage at Edenbane Road, Kilrea in a rural area for a private client.

This was an enforcement situation where the Applicant had been advised that if she did not apply for permission she would be served with an Enforcement Notice.

There was significant objection to the proposal from a neighbour, local Councillors, an MLA and the District Council to such an extent that the Planning Service after  initially recommending approval then proposed to reverse their opinion to a refusal.

However, intervention by the Environment Minister resulted in an approval issuing on economic development considerations.

It is now extremely difficult to get planning permission for a new rural based business if it is not farm based as both PPS 21 and PPS 4 provide a general presumption against new businesses in the countryside.
