First Farm Turbine Airport Appeal Success.

MKA Planning has been successful at planning appeal in getting a farm turbine approved within the City of Derry Airport’s (C.O.D.A) protected airspace.

MKA Planning overcame visual amenity objections through negotiations with Planning Service prior to the hearing.

Extensive negotiations with C.O.D.A before the hearing also resulted in objections on public safety and prejudice to existing and future radar at C.O.D.A being withdrawn by the Department at the appeal hearing.

The Commissioner imposed a planning condition requiring an agreed mitigation strategy to over come any airport public safety  concerns and any potential prejudice to existing and future radar at CODA  to be implemented prior to the turbine becoming operational.

Nearly twenty similar applications for farm turbines in the C.O.D.A  protected airspace have been refused on  aviation safety grounds.  This appeal decision may now set a precedent for other permissions.  If you are considering a farm turbine in this area or are having difficulties with an existing application feel  free to contact the Practice.
